HACC Appeals Chamber refuses to change measure of restraint for Pashynsky
The Appeals Chamber of the High Anti-Corruption Court (HACC) at a meeting on Monday considered the appeal of the prosecution against the determination of the investigating judge of the HACC dated February 1 to change the measure of restraint for the former MP, the HACC Appeals Chamber said in the Telegram channel without indicating the name of the ex-parliamentarian.
As follows from the plot of the case, we are talking about Serhiy Pashynsky.
"Based on the results of the review, the panel of judges upheld the prosecution's appeal, overturned the ruling of the investigating judge of the High Anti-Corruption Court and issued a new ruling, according to which the defense was denied the satisfaction of the motion to change the suspect's preventive measure. Thus, the suspect continues to be subject to a preventive measure in the form of bail in the amount of UAH 272.52 million," the HACC said.
The decision entered into legal force from the moment of its announcement and is not subject to appeal in cassation.
According to the investigation, the former MP is suspected of participating in a criminal organization and taking possession of seized petroleum products worth about UAH 967 million under Part 1 of Article 255, Part 5 of Article 191 of the Criminal Code of Ukraine.
As reported, on February 12, NABU, SAPO and SBU notified former MP Pashynsky and his business partner of suspicion for the illegal appropriation of petroleum products and causing the state almost UAH 1 billion in losses under Part 5 of Article 191 and Part 1 of Article 255 of the Criminal Code of Ukraine. They are suspected of illegally appropriating and selling 97,000 tonnes of petroleum products confiscated by the state in 2014 from the structures of businessman Serhiy Kurchenko, which were supposed to go to the needs of the army.
