Court orders contractor to return nearly UAH 900,000 for unfulfilled Kharkiv fortification contract

The Commercial Court of Kharkiv Region upheld the claim of the Shevchenkivsky District Prosecutor's Office of the city and ordered the contractor (limited liability company) to return to the state almost UAH 900,000 that were not spent under the contract for the construction of fortifications in the region.

"The court established the fact of violation of the terms of the contract and confirmed the state's right to recover almost UAH 900,000," the press service of the Kharkiv Regional Prosecutor's Office reports.

As it was established, in February 2024, Kharkiv Regional Military Administration and a company signed a contract worth over UAH 22 million for the construction of fortifications.

The contractor received an advance payment of UAH 9.9 million. Under the terms of the contract, these funds were to be used to purchase materials, and after completion of the work, they were to be confirmed by acts or returned.

The customer repeatedly emphasized that the construction was of strategic importance for the defense capability of the region, so the deadlines for completion and the targeted use of funds were critically important.

However, the contractor violated the established deadlines and did not return the money to the budget.

In this regard, the prosecutor's office filed a lawsuit to recover unused funds, penalties and fines.

The court decision has not entered into force, the appeal period is ongoing.
