Candidate for head of the Bureau of Economic Security reports restricted access to evaluation results
Victor Dubovyk, a candidate for the position of Director of the Bureau of Economic Security of Ukraine (BES), has publicly stated that the competition commission has violated the principles of openness and transparency. According to a post on his Facebook page link, Dubovyk claims he was denied access to the results of the practical stage of the competition, as well as the identities of the experts who conducted the evaluation.
“The competition, which was meant to be a model of transparency, is turning into a fortress resistant to any attempt at public dialogue. I received no substantive response—despite being a candidate in the process myself,” Dubovyk wrote.
He noted that the commission failed to provide information about the evaluation methodology, correct answers to the tasks, or confirmation that confidentiality protocols had been followed. The head of the commission reportedly justified this by claiming that the body does not make decisions binding on third parties and is not a holder of public information.
Dubovyk compared the situation to the legal doctrine of the “fruit of the poisonous tree,” often applied in the case law of the European Court of Human Rights and the Supreme Court of Ukraine. He argued that questionable evaluation procedures undermine public trust in the legitimacy of the competition.
